These Terms of Service ("Terms") are a binding agreement between you and Lowball ("we", "us", "Lowball") and govern your access to and use of https://lowball.it (the "Service"). By accessing or using the Service you agree to be bound by these Terms.
Lowball is a daily online game in which each registered player submits one integer per round. After picks close at 8:00 PM Eastern Time, we identify the lowest integer that exactly one player submitted; that player wins the round and receives tokens. Tokens and coins are non-monetary experience points used solely within the Service.
From time to time we may run a sweepstakes or prize promotion in which eligible players are automatically entered based on their play activity (for example, a monthly drawing among players who played at least N days during the month). Such promotions are governed by their own official rules, which control in the event of any conflict with these Terms. Key principles:
You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or legal guardian agrees to these Terms on your behalf. The Service is offered worldwide except where prohibited by law.

The Service, including its source code, design, text, graphics, logo, and branding, is owned by Lowball and protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.
The Service uses third-party services for hosting (AWS), email (Amazon SES), SMS (Plivo), and advertising (Google AdSense and, where applicable, Google AdMob for rewarded video). Your use of those services through Lowball is also subject to those providers' terms.
The Service displays advertisements served by Google AdSense and its partners. We are not responsible for the content of third-party advertisements, the products or services advertised, or any interaction you have with an advertiser. Clicking an ad takes you to a third-party site governed by that site's terms.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
To the maximum extent permitted by law, in no event will Lowball be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with the Service. Our total liability to you for any claim related to the Service is limited to the amount you have paid us in the prior 12 months, which (since the Service is free) will normally be zero.
You agree to indemnify and hold Lowball harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.
You can stop using the Service and delete your account at any time by emailing play@lowball.it. We may suspend or terminate your access at any time, with or without cause or notice.
We may update these Terms from time to time. Material changes will be posted at this URL and the effective date updated. Continued use of the Service after a change constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in New York County, New York.
